 Offer & Acceptance

According to section 2(a) of Indian contract Act, 1872, a proposal is defined as:

“When one person signifies to another his willingness to do or abstain from doing anything, with a view to obtaining the assent of that other to such act or abstinence, he is said to make a proposal”.

E.g.1: A offers to sell his bike to B for Rs.10, 000

E.g.2: A offers not to file a suit against B for breaching a contract, if B pays Rs.25, 000 to A.

Every agreements or contract requires at least two parties; the person making the offer is known as the offeror, proposer or promisor and the person to whom the offer is made is called the promise or offeree. The proposal when accepted becomes a promise.
