Who Can Demand Performance?

 

The following persons can make a valid demand for performance:

Promisee:

Normally, promise is the only person who can demand performance of the promise under a contract. A third party, being stranger to the contract, cannot demand performance of the contract.


Legal Representative:

In case of death of the promise, his legal representative can demand performance, unless a contrary intention appears from the contract or the contract of personal nature.


Third Party:

In some exceptional cases, the third party can also demand performance of the contract even though he is not a party to the contract.
