A teacher slapped a student, she suffered from 25% hearing loss which was healed by surgery, what kind of injury is this. (AIIMS Nov 2012)
The question is very specific in terms of legality, meaning now that the teacher has slapped & caused damage in the form of partial hearing loss, can a law suit be brought against her under sec.320IPC.
a. AIIMS always poses questions of practical importance & in this as a doctor examining the above said student u have to decide whether its simple or grievous.
b. The question is what type of INJURY it is & legally injury is classified as simple & grievous.
c. Let’s go on ruling out the wrong options first
d. It’s not a Grievous injury as clause iii of sec.320 clearly says it has to be PERMANENT PRIVATION(LOSS) OF HEARING OF EITHER OF THE EAR.
e. Hurt & injury have different definitions and meanings legally. Here the question is specifically on INJURY.
f. Thus answer is Simple Injury.
