Classification of Sexual Offence

Question
9 out of 43

An adult male accused of rape is brought for medical examination within 12 hours. Rape is not indicated if there is: (AIPG 2011)

A Presence of non-retractile prepuce

B Presence of smegma on glans penis

C Absence of injury marks on private parts

D All of the above

Ans. D
(A non-retractile prepuce is one which covers the glans penis, therefore the fact that the prepuce is covering the glans penis goes against performance of sexual intercourse (though not necessary). Presence of smegma rules out complete penetration as it gets rubbed off during sexual intercourse. It is collected again after 24 hrs. Absence of injury marks on private parts again goes against performance of rape (though not necessary). Therefore all of the 3 options go against commission of rape.)
