Types of Conditions
- Express conditions: Express conditions are those which have been expressly agreed upon by both the parties at the time of making the contract of sale. It is open to both the parties to contract, to include any number of express conditions in the contract.
When the buyer desires to buy Nokia mobile model no. 1100, in this case the brand and the model no. is express condition to a contract of sale.
- Implied conditions: It is the stipulation which has not been included in the contract of sale in express words. But the law presumes that the parties have incorporated it into their contract. Both the parties are bound by the implied conditions unless they are excluded by the express agreement of the parties.
