Liability of the buyer for refusing to take delivery of the goods

Sometimes, the seller is ready and willing to deliver the goods, and requests the buyer to take the delivery. But the buyer does not take the delivery of the goods within a reasonable time. In such cases, the buyer is liable to the seller for the following:
  • Any loss which arises due to the buyer’s neglect or refusal to take the delivery of the goods and
  • Reasonable charges for the care and custody of the goods

Note: Where the neglect or refusal of the buyer to take delivery amounts to repudiation of contract, the seller may sue for price or for damages.
