Conditions for Enforceability
Enforceability means an agreement which creates some legal obligation. If this agreement is not followed by any party to contract, he can be sued.
According to Sec. 10, βAll agreements are contracts, if they are made by the free consent of the parties, competent to contract, for a lawful consideration with a lawful object, and not hereby expressly declared to be void.β This definition clearly states that all agreements are not necessarily contracts. Thus an agreement can turn into a contract if the above guidelines are fulfilled.
