Partner by holding out

In cases where a person permits herself to be held out as (whether in writing, or orally, or through conduct), or represented as a partner in a firm, she would be liable as a partner of that firm to people who act on the faith of this representation irrespective of whether or not she was aware of the representation and that the third person believes the representation. In a partnership business a person should only hold himself out, if he actually is a partner.
