Under IPC, a person below ……. years is not criminally responsible: (AIIMS May 2012)
(According to S. 82 IPC Nothing is an offence which is done by a child under 7 years of age. Exception to this is the Indian Railways Act where a child above 5 years is liable for his actions if he hurts railway passengers or damages railway property. If IPC is specified than the answer will be 7 years, if nothing is specified than the answer will be 5 years.
However, for any offence done by a child between 7 and 12 years of age, the court shall decide whether it is an offence or not, depending upon the level of maturity of understanding by the child of the nature & consequences of his conduct at that occasion, S. 83 IPC.)
